MANITOWOC, Wis. (WFRV) – A Manitowoc man will not stand trial Tuesday after his attorneys announced a motion to appeal a judge’s decision to reject a plea deal.
Court records show that 54-year-old Timothy Hauschultz, who faces multiple felony charges in connection to the 2018 death of seven-year-old Ethan Hauschultz, will have his jury trial delayed.

During court Monday, Hauschultz and his defense attorney filed a motion asking the court to reconsider its rejection of his plea deal. The prosecution also joined in submitting a motion for reconsideration. However, court records show the judge denied both motions, stating the court “did not find that it would be in the public’s best interest.”
The charges stem from an incident in which Ethan was reportedly forced to carry a heavy log as punishment. Police reports state that while carrying it, he was kicked, hit, and knocked to the ground by Timothy’s then-15-year-old son, Damian Hauschultz. Damian allegedly rolled the log on top of Ethan and buried him in the snow, leading to the child’s death.
At the time, Timothy Hauschultz was the boy’s legal guardian.
In 2021, Damian was sentenced to 20 years in prison and 10 years of extended supervision for his role in Ethan’s death.
Tina McKeever-Hauschultz, who also played a role in the events leading up to Ethan’s death, served five years in prison and was released to extended supervision in January 2024.
